FACT FINDING OF BDMW ON BRUTAL MURDER OF HINDU COLLEGE STUDENT – KALLAYAN SARKAR (HRIDOY) AT ASHULIA POLICE STATION OF DHAKA DISTRICT (Source: The Samakal dated 27th June 2018, The Prothom Alo dated 27th June 2018. Mobile Number: +01642410069 Name of perpetrators: 1) Abdul Quddus (45), 2) Mohammad Rony (20), 3) Mohammad Nazrul, 4) Mohammad Sumon, 5) Mohammad Yar Khan (30), All of Sandwip, Ashulia, Savar, Dhaka. Date of investigation: 17.07.2018. FACTS OF THE CASE:- Kallayan Sarkar (Hrdoy) 20 – Hindu student of the 1st year -Department of English at Savar University College within Dhaka -Bangladesh. He lived with his father and mother within the Dairy Farm. He protested against extortion of money by Abdul Quddus – Head Master of Dairy Farm High School, located at Ashulia police station at Dhaka from a destitute Puska seller within the school campus. Abdul Quddus became angry with such protest attitude of Hrdoy and bear a grudge on him and intended to kill Hrdoy on any ground. On 20.06.2018 when Kallayan Sarkar (Hrdoy) was coming from his home towards the school at about 6 p.m. the Head Master of the School -Abdul Quddus caught hold of Hrdoy and started to beat him mercilessly with GI Pipe and other materials resulting Hrdoy became senseless and he was taken to nearest Enam Medical College Hospital at Savar P.S. for treatment. Hrdoy was kept ICU (Neurology department) in the college and died on 26.06.2018 at about at 8 a.m. LEGAL ACTION:- Ms. Rita Rani Biswas-mother of victim lodged first information report (FIR) on 25.06.2018 being case No.64/528 under section 143/341/323/325/307/114 of the penal code. After death section 302 of penal code has been included against five perpetrators. But police did nothing to arrest any perpetrators. The mother of the victim made the appeal to Human Rights Group for legal help and she also made the appeal to Prime Minister of Bangladesh, Home Minister of Bangladesh, Inspector General of Police, Bangladesh and other law enforcing authority for proper justice and for an immediate arrest of perpetrators. But she did not receive any help from the Government to date. INVESTIGATION : – I, Adv. Rabindra Ghosh, Rabindra Nath Baral, Goutam Roy, Md.Sohag, Anas Rabbi of Bangladesh Minority Watch visited the spot, talked with local witnesses and also police officers of Ashulia PS who admitted the unfortunate incident and said due to an abnormal beating by the local Head Master -Abdul Quddus the victim sustained multiple injuries and after admission to Enam Medical College Hospital Hridoy died on 26.06.2018 at about 8 a.m. Mother & father of the victim cried for proper justice and for arresting the perpetrator-Headmaster and other co-accused. We have also talked with other school teachers who also said: ” The incident of beating is most cruel in nature and the perpetrators should be punished as per law.” We also talked with SP Dhaka over the phone who said the perpetrators will be arrested soon, but he could not say why perpetrators, although identified, were not arrested. The statements of O.C. (Investigation) before us is not in accordance with law and he tried to hide the facts during our fact-finding at the police station. We also got information from a reliable source that the perpetrators are trying to create forged documents from the Medical College to escape those perpetrators. We came back from Ashulia on the night at about 10 p.m. RECOMMENDATIONS : – Bangladesh Minority Watch is shocked at the death of minority Hindu Kallayan Sarkar (Hridoy) by beating, BDMW is very much concerned about a slow motion of the investigation conducting by police. The show and mode of action by police are not praiseworthy. The perpetrators should be arrested and deterrent punishment should be imposed for mete out justice equitably. Compensation of medical expenses should be paid to victim’s mother.
